Lindsay Lohan has filed an appeal against the ruling by Judge Elden Fox Friday morning, September 24, to send her to jail till October 22, without giving her an option to post bail.
The judge, who is presiding over Lindsay 2007 DUI case, handed down the dramatic sentence after Lindsay appeared before him for a hearing after having failed two court mandated drug tests.
Lindsay, 24, will stay in jail till a hearing on October 22, when the judge will decide whether she violated the terms of her probation.
Following the ruling, Lindsay was led out of the Beverly Hills courtroom in handcuffs and booked and sent to the Lynwood Correctional Facility.
In the afternoon, Lindsay's lawyer, Shawn Chapman Holley, met Judge Fox in his chambers along with the deputy District Attorney, in a desperate attempt to convince the judge to let Lindsay post bail. The judge refused to change his ruling in any way.
"Lindsay's defense is simple: Judge Fox doesn't have the right to deny her bail," a source tells Radar Online.
In July, Lindsay was sentenced to 90-day jail followed by 90-day rehab by Judge Marsha Reve for violating the terms of her probation. However, she spent 13 days in jail, because of overcrowding, and 21 days in rehab, because UCLA doctors told Judge Fox that she didn't need more rehab.
While ordering her early release from rehab on the recommendations of the doctors, Judge Fox had warned Lindsay that fresh violations of the terms of her probation would entail 30 days in jail.
Lindsay's mother, Dina, sat behind Lindsay at the hearing this morning, while her father, Michael, sat at the back of the courthouse.
While in jail, Lindsay will be allowed visitations by her psychiatrist, Dr. Lee Sadja, and her lawyer, Shawn Chapman Holley.
